The Magic Streams L.P provides Web Hosting & Streaming services to clients worldwide, with the responsibility to protect each client and provide the best available services. All clients of Magic Streams L.P are subject to the following service terms of use. Please read them carefully and visit our pages only if you fully agree with them. The Magic Streams L.P reserves the right to modify or temporarily or permanently discontinue parts or all of its services, with or without prior notice to users or members.
Domain Name Registration Policy with .gr Extension
The client/user and/or prospective owner of the domain names must read, understand, and agree with the Domain Name Management and Registration Policy with the .gr extension and all amendments thereof. In particular, they should carefully read Article 5 of the regulation, which outlines the reasons for rejecting a domain name registration application. On the page of the EETT, you can find all regulatory texts and any amendments to them. The visitor or user is responsible for having the necessary equipment to access the pages of Magic Streams L.P and for covering any fees that may be required to gain such access (e.g., network connection charges, access time charges, etc.).
The Magic Streams L.P assumes no responsibility for communication between users or members and third-party service providers that may be advertised on its website, nor for any potential commercial transaction between them. The information provided on the website of Magic Streams L.P should be verified by visitors for accuracy.
User Responsibility
Users agree not to use the services provided by Magic Streams L.P for:
1. Sending, publishing, emailing, or transmitting any content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or discriminatory based on race, ethnicity, or other criteria.2. Harming minors in any way.
3. Adult content - pornography, gambling, or any other content prohibited by Greek law.
4. Sending or mass emailing for advertising purposes without the recipient's consent.
5. Sending, publishing, emailing, or transmitting any content that you do not have the right to transmit under the law, contracts, or management relationships (such as internal information, proprietary and confidential information acquired or disclosed as part of employment relationships or covered by confidentiality agreements).
6. Sending, publishing, emailing, or transmitting any content that violates any patent, trademark, trade secret, copyright, or other proprietary rights of any party.
7. Sending, publishing, emailing, or transmitting any material containing software viruses or any other codes, files, or programs designed to interrupt, damage, destroy, or impair the operation of any software or hardware.
8. Intentional or unintentional violation of applicable laws or regulations.
9. Harassing third parties in any way.
10. Collecting or storing personal data about other users.
11. Distributing pirated software, MP3 files, and movies.
12. Hosting forums with links to content that you do not have the right to transmit under the law, contracts, or management relationships.
13. Mass mailing of emails for advertising purposes - Spam Mails.
Mass mailing for commercial advertising purposes is PROHIBITED by Greek law. Theoretically, mass email sending for commercial purposes (for advertising) is permitted only when the recipient has given explicit consent to receive electronic messages from the specific email address.
If the above rules are violated and we receive a notice from the data center regarding the sending of spam mail, the hosting account will be terminated without prior notice.
Resource Usage
The client agrees to make reasonable use of the server resources hosted by Magic Streams L.P, acknowledging that not all server resources are intended for their exclusive use and that they share the server resources with other users.
As a limit on the usage of the server's computing power (CPU) and memory, a threshold of 10% of the total server resources is established. If the processes running on the client's hosting account consistently exceed the consumption of 10% of the total server resources, the client will be notified to terminate those specific processes.
If the specific processes cause or may cause issues to the smooth operation of the server, negatively impacting other clients, Magic Streams L.P reserves the right to terminate the processes without prior notice to the client or even disable the hosting account if deemed necessary.
The available server resources are exclusively intended for use within the hosting accounts of the clients of Magic Streams L.P.
It is strictly prohibited to allocate resources in any way to third-party sites, including but not limited to pulling graphics or text from third-party sites or hosting material on a server belonging to Magic Streams L.P, running banner exchange programs, etc.
The use of IRC bots and chatrooms is explicitly prohibited due to the excessive load that these applications cause on the servers.
Denial of Service
Magic Streams L.P reserves the right to refuse or cancel the provision of services. Violation of the rules and regulations of Magic Streams L.P may lead to a warning, suspension, or even possible termination of the service. Accounts that are deleted due to a violation of the policy of Magic Streams L.P will not be compensated.
In the event of exceeding the monthly data transfer limit, an additional charge will be imposed for every extra MByte according to the current price list of Magic Streams L.P.
Monthly data transfer includes all data (such as page traffic, FTP traffic, email traffic, etc.) from and to your account (i.e., the disk space where we host you).
Services and Responsibility of Magic Streams L.P
1. The Client certifies that the material they upload to the server will be ready for use and will not require any additional processing from Magic Streams L.P to function. Magic Streams L.P has the right to access the Client's files, websites, and data.2. Magic Streams L.P notifies the client via email on how to access their Control Panel and how to publish their files on the Internet, set up their email accounts, and the necessity of reading the manual of their virtual server and Control Panel.
3. The Client agrees that they possess the necessary knowledge to build/publish their websites on the Internet and acknowledges that Magic Streams L.P is not responsible for providing this knowledge or other programming skills to the Client, nor for training them. Magic Streams L.P is not obligated to provide technical support, except for cases specified herein. Magic Streams L.P may, as an exception and at its own discretion, offer support and advice on issues not related to hosting (additional Technical Support).
4. Any request for additional Technical Support may be denied by Magic Streams L.P with or without justification. It is solely at the discretion of Magic Streams L.P whether to provide any additional Technical Support, and if offered once, it may be discontinued at any time without notice and without obligation or liability to Magic Streams L.P.
5. Magic Streams L.P does not control the content of the information passing through its network of servers and does not guarantee the reliability of any information displayed on the Internet through or because of its services. Furthermore, it does not guarantee the commercial or personal credibility of any entity presented on the Internet or the fulfillment of any specific promises/offers from third parties and is not liable for any damages that may occur to the client or those transacting with them, including data loss due to delays, undelivered goods, or service interruptions for any reason, error, or omission.
6. The use of any information provided via the Internet is at the sole responsibility of the user, and Magic Streams L.P assumes no responsibility for the accuracy or quality of such information. The connection speed mentioned on the website represents the speed to the backbone network, not the end-to-end speed.
7. Magic Streams L.P assumes no liability for any damage caused in the event of network or system unavailability and does not guarantee that the hosting service will be uninterrupted or error-free due to the special nature of the Internet and the networks through which information is distributed.
8. Under no circumstances and for no reason shall Magic Streams L.P be held liable for any damage resulting from the use, availability, or unavailability of the services offered.
9. Magic Streams L.P periodically upgrades installed applications on its servers to maintain the highest possible security levels and provide the latest versions of Control Panel, PHP, MySQL, ASP.net, Perl, Zend, Ioncube, etc. It is the sole responsibility of the client to update their code (PHP, MySQL queries, ASP, etc.) of the websites hosted to be compatible with the servers of Magic Streams L.P. Magic Streams L.P is not liable for any loss, damage, or moral harm resulting from these upgrades or the client’s failure or reluctance to adapt their websites to updated versions of various applications and programming languages installed on the servers.
10. Magic Streams L.P assumes no responsibility or obligation for compensation for any loss, damage, or moral harm resulting from the inability to provide services or technical support. The Client agrees, upon acceptance of this agreement, not to raise any claims.
11. Magic Streams L.P regularly takes backups of files and databases of clients using hosting services on its servers. File restoration from backups is chargeable. Magic Streams L.P assumes no responsibility if the backup is outdated or unusable. The Client is obligated to maintain backups of their files and databases using the Backup/Restore tool provided through the Magic Streams L.P Control Panel. For security reasons, the backup should be transferred via FTP to the Client's computer.
12. Magic Streams L.P will deliver services/products within a few minutes from the time of payment. In some cases, due to the nature of the service, delivery may be delayed by several hours or days.
13. Magic Streams L.P will cooperate with the competent authorities for law enforcement regarding the Client’s space, data, emails, and content. This may result in Magic Streams L.P disclosing all information provided, including data stored on its servers, files, and databases.
14. Magic Streams L.P is not liable to clients/users for damages that may arise from the execution or non-execution of their order or the service provision method. It also reserves the right regarding the delivery time of products/services in cases of force majeure.
15. Magic Streams L.P enters into partnerships or alliances with other companies and suppliers. The client acknowledges and agrees that Magic Streams L.P is not responsible for the products or services of any third party, nor will it be liable for any claims arising from the provision of those products or services.
16. If the server hosting your shared or reseller hosting package experiences more than 0.1% physical downtime within a calendar month, you may receive one month in credits to your account. Approval of credits is at the company’s discretion and based on the reason provided. Third-party server monitoring data cannot be used as evidence.
17. Service Provision Agreement.
This agreement describes the network uptime guarantee for the services of Magic Streams L.P. The guarantee applies to any client of Magic Streams L.P without financial arrears during the downtime period.
Form and Procedure for Guarantee Implementation
The primary objective of Magic Streams L.P is to keep the hosted website content available (uptime) for access from anywhere in the world, at all times. Downtime is defined as the loss of all packets from Magic Streams L.P to the backbone network providers.
The goal of Magic Streams L.P is to maintain the average downtime of Webserver or Database Server availability at 0.1% or less during a calendar month, as measured by Magic Streams L.P.
If the Webserver or Database Server of the shared hosting package where your site is hosted is available for less than 99.9% during a calendar month, Magic Streams L.P will credit your hosting package with one month of free hosting.
Downtime is measured after notification by the client of the unavailability at the moment of interruption through the Magic Streams L.P ticket system or by phone to the Customer Support Department of Magic Streams L.P. The administrators of Magic Streams L.P will determine the end of the downtime period.
The credit applies to the monthly fee of the basic service paid by the client for the package, for the allowed data transfer limit per month, excluding charges for additional services, such as extra IP addresses, support services, etc.
Limitations
The Client will not receive any credit for any failure, malfunction, or unavailability of their website caused or related to:
1. Circumstances beyond the reasonable control of Magic Streams L.P, including but not limited to government actions, war, riots, sabotage, armed conflict, embargo, fire, flood, strike, or other labor disturbance, interruption or delay in transportation, unavailability or interruption or delay of telecommunications or third-party services, hacker or virus attacks, third-party software failure (including but not limited to ecommerce software, payment gateways, chat, statistics, or free scripts), or inability to obtain raw materials, supplies, or power required for the appropriate equipment to deliver this SLA.2. Scheduled or emergency maintenance and improvement of the company's technological equipment.
3. Issues related to DNS, FTP, POP, IMAP, or SMTP access by clients.
4. False reports of non-functioning systems of Magic Streams L.P.
5. Acts or omissions by the client, including but not limited to code (e.g., CGI, Perl, HTML, ASP, etc.), any negligence, willful misconduct, or use of services in violation of the terms of Magic Streams L.P and the provisions of the acceptable use policy.
6. Delivery or transmission of email or webmail.
7. Network outages elsewhere on the Internet that prevent access to the Client. Magic Streams L.P is not responsible for browser issues or DNS problems that may prevent the appearance of the service to the Client.
Additionally, Magic Streams L.P is not responsible for problems caused by the quality of Internet access from the provider chosen by the Client.
Magic Streams L.P guarantees only those areas under its control, namely the servers, the routers of the servers, and their connection to the Internet.
Money-Back Guarantee
1. The virtual server hosting packages provided by Magic Streams L.P are accompanied by a 30-day money-back guarantee from the date of account activation.If the client is not satisfied with the hosting service level provided by Magic Streams L.P, they can request cancellation of this agreement within 30 days from the account activation date. Otherwise, they implicitly agree to continue using the service and waive their right to a refund of the paid amount.
In the case of cancellation within 30 days, the subscription amount will be refunded to the client.
If the subscription amount included additional costs (such as domain name purchase, SSL purchase, dedicated IP purchase, third-party fees, bank or credit card fees, setup fees, additional services), the subscription fee will be refunded to the Client after deducting the above expenses.
No refund will be issued after the 30th day of the subscription.
The above guarantee exclusively applies to Web Hosting & Web Radio rental packages and not to the entirety of the services provided by Magic Streams L.P, such as Dedicated Server, Resellers Hosting, etc.
For Dedicated Server and related addons, no refunds are offered.
2. Only new accounts are eligible for refunds. For example, if a client previously had an account with Magic Streams L.P, canceled it, and then created a new one, they are not eligible for a refund for the latest account.
3. To be valid, the cancellation request must be submitted through the form available on the package management page of Magic Streams L.P.
4. If the client received a code for free registration or renewal of a Domain Name when purchasing a hosting package, and has requested cancellation, the total registration or renewal cost of the Domain Name will be deducted from the final refundable amount.
5. If the client first acquired a trial package, they are not entitled to a refund as they have tested the service before paying.
6. In cases where the payment was made via Paysafecard, the refunded amount will be credited to the client’s account since the payment gateway does not support direct refunds.
7. Any violation of the terms of this agreement is considered sufficient to result in the non-refund of any amount to the Client.
Cancellations/Payments for Dedicated Server
All cancellations and payments for Dedicated Server must be made 5 days before their expiration, not later. If a renewal invoice has been generated, it must be paid.
Cloud VPS Hosting
1. Services Provided: The service provider (hereinafter referred to as "we", "us", or "the company") provides Cloud VPS Hosting services according to the agreed specifications.
2. Rights and Restrictions: Users (hereinafter referred to as "you" or "the user") have the right to use the resources allocated to them according to the usage agreement. This right is subject to the restrictions set by the company, including but not limited to bandwidth usage, storage space, and processing power limitations.
3. Payments: Payments must be made according to the specified payment deadlines. Non-payment may result in suspension or termination of services.
4. Violations: Violation of these terms, including resource abuse, may lead to immediate suspension or termination of services without prior notice.
5. Liability: The company is not liable for any data loss, service interruption, or other damages resulting from the use of the services.
6. Upgrades and Updates: The company reserves the right to update or upgrade services without prior notice.
7. Disputes: Any disputes arising between users and the company should be resolved through negotiation or arbitration.
8. Validity: These terms of use take effect from the date of your registration to the services and remain valid until terminated or revoked by the company.

This upgrade turns your root VPS into a managed server:
Our technicians take care of security, updates, and system stability. Additionally, you can benefit from our extensive customer support whenever needed. After ordering this upgrade, simply inform us about the technical tasks you would like to perform, those that need to be done once, and those to be carried out every month. Our team of skilled technicians will then implement your requirements. The price of this upgrade includes two full hours of technical support per month. If any of your tasks take longer, we will contact you immediately. You can then decide whether it should be charged separately or have its scope limited, for example.

Service fees cover costs related to transaction management and processing, administrative support, and mediation between the customer and payment service providers. These fees are fixed or calculated as a percentage of the final payment amount.
2. When Are Service Fees Applied:
Service fees are applied regardless of the payment method, as they cover costs arising from transaction processing and the provision of administrative support.
3. Duration and Validity of Service Fees:
Fees apply to all transactions made through our platform and are automatically applied when the invoice is issued.
4. Legality and Transparency:
Service fees comply with applicable legislation and are clearly displayed during the payment process so that you know the exact amount before completing the transaction.
5. Alternative Payment Methods:
Where possible, alternative payment methods are provided that do not incur additional charges. Users can choose their preferred method, being aware of the related costs in advance.
6. Commitment to Transparency:
Our company is committed to transparency in charges and full disclosure of any additional fees to our customers before the completion of payment.
Important Note:
The selection of specific payment methods does not incur additional charges beyond the general service fees, which apply regardless of the payment method and cover management and support costs.
